Hostifull Terms of Service Agreement

Welcome to Hostifull! By using our services, you agree to comply with and be bound by the following Terms of Service. Please read these terms carefully before accessing or using our services.
- Overview
This Terms of Service Agreement (the “Agreement”) is entered into by and between E. zona, MB (referred to as “Hostifull,” “we,” “us,” or “our”), with the company code 305028946, located at Tvirtovės al. 88, LT-50185 Kaunas, and you, the customer (referred to as “you,” “your,” or “Customer”). This Agreement is effective as of the date you use our website Hostifull.com or electronically accept this Agreement.
This Agreement governs your use of Hostifull’s services, including but not limited to website hosting, VPS servers, Dedicated servers, Bare metal servers, VDS servers, WooCommerce hosting, WordPress Hosting, Colocation, and other related services (collectively referred to as “Services”). By using our Services, you agree to comply with this Agreement, along with any additional policies or agreements referenced herein.
- Eligibility and Authority
To use our Services, you must be at least 18 years old or have the legal capacity to enter into binding contracts under applicable law. If you are entering into this Agreement on behalf of a company or other legal entity, you represent that you have the authority to bind such entity to this Agreement.
2.2 Sanctions Compliance
You agree not to use our Services in any country or region subject to comprehensive sanctions by the US, EU, UN, or other applicable jurisdictions. You confirm that you are not listed on any sanctions lists and are not owned or controlled by any sanctioned individual or entity. If your status changes, you must notify Hostifull immediately. Hostifull reserves the right to terminate your Services if you violate these sanctions.
- Account Management
3.1 Account Creation
To access certain Services, you must create an account (“Account”). You agree to provide accurate, current, and complete information during registration and to keep this information updated. Hostifull reserves the right to suspend or terminate your Account if we believe your information is inaccurate or incomplete.
3.2 Account Security
You are responsible for maintaining the security of your Account, including your password and payment methods. You must notify Hostifull immediately of any unauthorized use of your Account. Hostifull is not liable for any losses resulting from unauthorized access to your Account.
3.3 Transfer of Data
If you access our Services from a country other than where our servers are located, your data may be transferred across international boundaries. By using our Services, you consent to such transfers.
3.4 Account Sharing
You may grant access to your Account to other users, but you are solely responsible for their actions. Hostifull is not liable for any actions taken by individuals you authorize to access your Account.
- Service Availability
4.1 Service Uptime
Hostifull will use commercially reasonable efforts to ensure that our Services are available 24/7. However, we do not guarantee uninterrupted access and are not liable for any downtime caused by maintenance, equipment malfunctions, or other factors beyond our control.
4.2 Beta Services
From time to time, Hostifull may offer beta versions of new Services (“Beta Services”). These are provided “as is” and may contain bugs or other issues. Your use of Beta Services is at your own risk.
- Definitions
- Application Hosting: A hosting service that enables customers to run applications on provided server space.
- Wallet / Balance: A virtual balance available in the user panel for transactions.
- Client – User – (Service Customer): An individual or entity utilizing Hostifull’s services.
- Node: A physical server hosting multiple customer accounts.
- VPS: Virtual private server.
- VDS / KVM: Virtual dedicated server.
- User Panel: The online management interface for Hostifull services.
- Discount Code: A one-time promotional code reducing service prices.
- Network Attack: Any malicious activity, such as DoS/DDoS attacks, aimed at Hostifull infrastructure.
- Services Provided
We provide web hosting, virtual machines (VMs), Virtual Private Servers (VPS), dedicated servers, bare-metal servers, storage servers, and related services. The specifics of each service are outlined in the individual service agreements or product descriptions on our website.
- Client Responsibilities
7.1. You are responsible for:
- Independently creating backups of your data.
- Not using our services for illegal purposes.
- Keeping your login credentials secure and confidential.
7.2. Additional obligations:
- Independently managing the services you purchase, including updating software and ensuring security. Alternatively, you may hire a qualified administrator for ongoing service maintenance.
- Ensuring that sub-users granted access to your services comply with these Terms of Service.
- Notifying the Service Provider of service issues that do not result from your own misconfiguration.
- Being at least 18 years old (or the applicable age of majority in your jurisdiction) and having parental or legal guardian consent if under the age of majority.
- Billing and Payment
8.1 Payment Terms
All invoices must be paid within the due date specified on the invoice. Failure to pay within 3 calendar days after the service plan expiration date will result in the permanent deletion of your server and associated data.
8.2 Domain Renewal
Domains must be renewed before their expiration date. If a domain is not renewed on time, it will enter a grace period during which you can still renew it, but additional fees may apply. If the domain is not renewed during the grace period, it will be released and may become available for registration by others. Hostifull is not responsible for any loss of domain ownership due to failure to renew on time.
8.3 Non-Refundable Funds
Funds added to the user panel wallet – balance are non-refundable and may only be used for purchasing Hostifull services.
8.4 Right to Refuse Service
Hostifull reserves the right to refuse the sale or renewal of services in cases where doing so could harm infrastructure stability or the company’s interests.
- Data and Backups
- You are responsible for maintaining backups of your data. While we may offer backup solutions, we do not guarantee their availability or reliability unless explicitly stated in your service plan.
- Data loss resulting from hardware failure, cyberattacks, or other disruptions is not covered under our liability.
- When using a dedicated server with a non-RAID configuration, we are not responsible for the risks associated with your unsafe use of the server. Should any information be lost, you are fully responsible. We strongly recommend using servers with RAID enabled to ensure data safety.
- Acceptable Use Policy
You agree not to use our services for any illegal activities, including but not limited to:
- Spamming (including mass mailing, search engine spam, PowerMTA software, etc.).
- Denial-of-service attacks (DoS/DDoS attacks).
- TOR nodes, Open proxies.
- Torrent.
- Cryptocurrency mining on virtual servers.
- Illegal copyrighted material (DMCA).
- Port/network scanning, brute forcing, IP spoofing, etc.
- Adult content if it doesn’t meet EU law.
- Phishing or scam websites, hacking (including if the server was hacked).
- Distributing malware.
- Any type of botnets.
- Blacklisting IPs in public blacklists and/or decreasing IP reputation.
- Any other activity which breaks EU laws.
You are prohibited from overloading the CPU usage to 100% for an extended period (refer to industry standards – 10 hours). Consistent abuse of system resources may lead to service suspension.
Violation of these rules may result in immediate suspension or termination of your services without a refund.
- Right to Suspend Services
We reserve the right to disable your server without prior notice if it is subject to a DDoS attack or if the server’s operation causes disruptions to our infrastructure.
While we will make reasonable efforts to mitigate the effects of network attacks (e.g., DDoS), we cannot guarantee full protection. Services may be disabled temporarily or permanently if attacks jeopardize infrastructure stability.
- IP Blacklisting
If our IP address(es) become blacklisted due to activities from your account, we may require a financial payment to cover the cost of delisting the IP address. This fee will vary depending on the extent of the issue and delisting service fees.
- Limitation of Liability
To the maximum extent permitted by law, we are not liable for any indirect, incidental, or consequential damages arising from the use of our services, including but not limited to data loss, revenue loss, or business interruption.
The Service Provider is not liable for damages resulting from:
- Actions of third parties.
- Force majeure events.
- Client misconfiguration or use of insecure software.
- Resource overloads caused by client-installed software exceeding allocated service parameters.
- Complaints and Resolution
- Clients may submit complaints via the support email or user panel.
- Complaints must include client details, a description of the issue, and the requested resolution.
- We will review complaints within 14 days and respond with a resolution where applicable.
- Test Servers
- Clients may be eligible for a one-time trial of up to [X hours].
- After the trial period, services and associated files are deleted unless payment is made for continued usage.
- Hostifull reserves the right to decline trial requests without specifying a reason.
- Service Level Agreement (SLA)
16.1 Uptime Guarantee
Hostifull guarantees 99.9% uptime for its services. If this guarantee is not met, customers may be eligible for service credits.
16.2 Maintenance Notifications
We will notify customers of scheduled maintenance or downtime at least 24 hours in advance, except in cases of emergency maintenance.
16.3 Service Credits
If uptime falls below the guaranteed level, customers may receive service credits as compensation. The amount of the credit will be proportional to the downtime experienced.
- Intellectual Property Rights
17.1 Customer Content Ownership
You retain ownership of all content you upload or create using our Services. However, by using our Services, you grant Hostifull a worldwide, non-exclusive, royalty-free license to use, reproduce, and distribute your content as necessary to provide the Services.
17.2 Trademark and Copyright Claims
If you believe your intellectual property rights have been violated, please contact us at info@hostifull.com with detailed information about the alleged infringement.
- Third-Party Services
18.1 Third-Party Integrations
Hostifull is not responsible for the performance or reliability of third-party services integrated with our platform.
18.2 Third-Party Links
Our website may contain links to third-party websites. Hostifull is not responsible for the content or practices of these websites.
- Force Majeure
Hostifull is not liable for service interruptions caused by events beyond our control, such as natural disasters, war, or government actions.
- Account Termination
20.1 Termination for Abuse
Hostifull reserves the right to terminate accounts immediately without refund if the customer engages in prohibited activities, such as spamming, hacking, or distributing malware.
20.2 Data Deletion
Upon account termination, all customer data will be permanently deleted. Customers are responsible for backing up their data.
- Customer Support
21.1 Support Channels
We offer support via email, live chat, and ticketing system.
21.2 Response Times
- Billing inquiries: Response within 24 hour.
- Technical issues: Response within 24 hours.
- Modifications to Terms
We reserve the right to update these Terms of Service at any time. Changes will take effect upon posting to our website. Continued use of our services constitutes acceptance of the updated terms.
- Governing Law
These Terms of Service are governed by and construed in accordance with the laws of the Republic of Lithuania. Any disputes will be resolved exclusively in the courts of Lithuania.
